California CALA Kicks off 'Create Jobs, Not Lawsuits Tour'

On February 23, California Citizens Against Lawsuit Abuse, a nonpartisan grassroots movement for legal reform, and Sick of Lawsuits will kick off the national "Create Jobs, Not Lawsuits Tour." The Tour will visit and team up with other reform organizations around the country in states feeling the strains of lawsuit abuse.

Project Lawsuit Abuse Newsmakers

Tort reformers have been turning up all over the internet recently. We took the liberty of rounding up some of the standouts. You may recognize a few friends of Project Lawsuit Abuse in there. Here are some of the newsmakers from around the country:

• Tripping? Beach injury? Debate heated on frivolous lawsuits
“People sue; and for all kinds of reasons. What qualifies as a frivolous lawsuit is a debate that has bounced back and forth between consumer rights advocates and tort reform activists for years, with no resolution.” The Orange County Register

ADA Lawsuits Plaguing California

There is one constant as I travel throughout the state of California. Whether I am speaking at a conference or meeting with business leaders, people are always asking me about Americans with Disabilities Act (ADA) lawsuits. Thousands of these ADA lawsuits have been filed in California and there is no end in sight. Every attempt to stop them at the state level has been blocked and those who think the California Commission on Disability Access will stop them need to have a reality check.

Where have all the playgrounds gone?

Here at Project Lawsuit Abuse, we talk about how fear of litigation costs us all – more than just financially – every day. Things get Complicated in Small-Claims Court

So, things are getting more complicated in the case of the Honda hybrid owner who took her case to small claims court rather than dealing with the often frustrating and little to no payout that often comes from class action lawsuits.

A California Superior Court Commissioner delayed a ruling this week on her case for more consideration after what he called “a media blitz on this case.”

• Legal reform absent from speech
“Gov. Earl Ray Tomblin's first State of the State address focused on creating jobs and economic growth. But he didn't mention legal reform. "It was a pro-jobs and pro-growth speech," said Steve Roberts, president of the West Virginia Chamber of Commerce. "Governor Tomblin is to be applauded for bringing so much focus to job creation and economic development."” The West Virginia Record

A new litigation trend?

When the class action system doesn’t work, sue elsewhere? That’s what Californian Heather Peters is doing.

The situation started when the Los Angeles woman was perturbed that her 2006 Honda Civic hybrid car did not reach its claimed fuel economy. Cases like this typically become class action lawsuits – especially in California.
