Let’s Debate!

With another presidential primary debate tonight, we have one question in mind:  Where do candidates stand on tort reform?

Alabama is Ripe for Reform

Prior to this year’s election, Alabama Voters Against Lawsuit Abuse (AVALA) sent questionnaires to Governor-elect Robert Bentley and Attorney General-elect Luther Strange regarding their beliefs on our civil courts. While the other candidates in their respective races failed to reply, Bentley and Strange both indicated that they support the types of reforms that Alabama needs.

Voters are Sick of it, too

Last week, the U.S. Chamber Institute for Legal Reform (ILR) released a national survey that shows that voters agree with us – there re to many lawsuits out there.

ILR polled 1000 voters last week on Election Day and the results showed that 88% of voters think there are too many “meritless” lawsuits, and further, they think the legislative branch should do something about it.

Voters recognize that the system has gone too far and are a detriment to our economy. With the realities of unemployment shaking our nation, business owners are frustrated with excessive litigation when it serves as a roadblock to hire new employees. Something's got to give.

Project Lawsuit Abuse Election Update

Midterm elections certainly shook things up this year at the federal, state and local levels. Republicans took back control of the US House of Representatives and picked up at least six seats in the US Senate, closing in on the margin of Democratic control. Several US House and Senate races are still close to call and are likely to be contested. 

However, most of the action on lawsuit reform occurs at the state level - so while state elections often took a back seat in the 2010 election coverage, Project Lawsuit Abuse was keeping track.

Get out the Vote!

That’s right – today is Election Day. States across the country have full tickets today – from candidates for federal, state, county and city offices to state propositions and local measures. The right to vote is yours, so get to your polling location and cast your vote.

Remember that Good Judges Matter on November 2

You’d have to be living under a rock not to know that a week from tomorrow is a big day. While congressional and gubernatorial races are grabbing headlines, we shouldn't forget about the judicial races. Travis Akin, Executive Director of Illinois Lawsuit Abuse Watch and friend of Project Lawsuit Abuse, has been taking the message that “Good Judges Matter” across the state of Illinois.

Much of the Same From the Trial Lawyers

November 2, 2010, marks a big day for those on both sides of the aisle. With the fate of many seats are a mystery at this point, it’s no surprise that this year was a big one in terms of campaign spending. While trial lawyers are generally known for pumping big bucks into democratic candidates’ campaigns, they surely outdid themselves this year.

Campaign spending has received heavy media attention this year. The National Law Journal reported, “At some law firms, they're contributing even more to federal candidates than they did in either of the previous two election cycles, including the 2008 campaign when presidential hopefuls were after their money.”

Friends of Project Lawsuit Abuse have been making their way into their local news recently:

•    An op-ed by David Houston, Chairman of California Citizens Against Lawsuit Abuse, was featured in the Los Angeles Business Journal today. Houston writes about the drastic impact abusive litigation has had on California’s public schools, saying “Our schools are now compelled to defend themselves against lawsuits for enforcing dress codes, cutting a student from an athletic team or punishing a student caught cheating.”

Texas Trial Lawyers Spend big on Democratic Nominee

Trial lawyers are known for throwing big bucks behind their candidates, but this year’s Texas gubernatorial election is proving to be a high stakes gamble: recent figures show that plaintiffs attorneys have contributed $1.9 million -through June - to Democrat Bill White’s campaign. Additionally, a Houston lawyer funded a political committee with $3 million to help defeat incumbent Republican Rick Perry.

The Burden of Lawsuit Abuse on Small Businesses

We often hear personal injury lawyers say they are fighting for the “little guy” … but what about those of us who are small business owners, working hard every day to run a business, provide for our families and create jobs? The personal injury bar’s agenda of expanding litigation and creating new ways to sue is a major threat to the livelihood of small businesses and the jobs they provide.
